By downloading, installing, or using Tornado Tracker by TornadoPath, a product of Ridge Labs LLC ("the App"), including without limitation the website at tornadopath.com, the iOS application, and any related services (collectively, the "Services"), you acknowledge that you have read and understood the terms and conditions of this Agreement and agree to be bound by all terms and conditions herein. If you do not agree to these terms, do not use the Services.
Tornado Tracker by TornadoPath provides tornado tracking, severe weather alerts, and notification services. The App displays weather data from the National Weather Service (NWS), Storm Prediction Center (SPC), and NOAA.

By subscribing to our alert services (phone calls, SMS text messages, or email alerts), you represent and warrant that you are the lawful owner or authorized user of the phone number(s) and email address(es) you provide. You consent to receiving automated phone calls and text messages as part of the alert services. If your contact information changes, you must update it promptly.
Standard call and message rates may apply from your mobile or wireless carrier. The frequency of alerts may vary depending on weather conditions and your alert settings. You may cancel alert services at any time through your dashboard or by contacting us.
Our use of the Services complies with applicable laws including the Telephone Consumer Protection Act (TCPA) and the CAN-SPAM Act.

ANY SAFETY-RELATED INFORMATION PROVIDED THROUGH THE SERVICES IS NOT INTENDED TO BE A SUBSTITUTE FOR OFFICIAL GOVERNMENT EMERGENCY ALERTS OR PROFESSIONAL SAFETY ADVICE.

You agree to cooperate fully with us in the defense of any such claim.
The Services, including their design, features, content, text, data, graphics, maps, and software (excluding third-party weather data), together with the selection and arrangement of such materials, are the property of TornadoPath and are protected by copyright, trademark, and other intellectual property laws. The removal of any trademark, copyright, or other rights notice is strictly prohibited. Except as expressly permitted herein, any use, reproduction, modification, distribution, or exploitation of the materials, in whole or in part, is strictly prohibited without the prior express written consent of TornadoPath.
The Services may contain links to third-party websites or display content from third-party sources. We do not operate or control, and do not necessarily endorse, the content found on these third-party websites. You assume sole responsibility for your use of third-party links. We are not responsible for any content posted on third-party websites or liable to you for any loss or damage incurred as a result of your dealings with any third party or their website. In many instances, content will include data from third-party sources (NWS, ECCC, NOAA). We do not endorse, warrant, and are not responsible for the accuracy, completeness, or reliability of any third-party data.
Each party agrees to first contact the other with any disputes and provide a written description of the problem, all relevant documents and information, and the proposed resolution. You agree to contact us at hello@tornadopath.com.
If after thirty (30) days the parties are unable to resolve any dispute, the dispute shall be submitted to binding arbitration. Each party agrees that any claim or dispute, including past, present, and future claims, shall be resolved by binding arbitration rather than in court. Either party may bring qualifying claims in small claims court. The arbitration shall be governed by the Federal Arbitration Act. Any award by the arbitrator may be entered as a judgment in any court having jurisdiction.
TO THE EXTENT ALLOWED BY LAW, YOU AND TORNADOPATH EACH WAIVE ANY RIGHT TO PURSUE DISPUTES ON A CLASS-WIDE BASIS; THAT IS, TO EITHER JOIN A CLAIM WITH THE CLAIM OF ANY OTHER PERSON OR ENTITY, OR ASSERT A CLAIM IN A REPRESENTATIVE CAPACITY ON BEHALF OF ANYONE ELSE IN ANY LAWSUIT, ARBITRATION, OR OTHER PROCEEDING. If for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate does not apply and the class-wide dispute must be brought in court.
TornadoPath will not be liable or responsible to you, nor be deemed to have defaulted or breached these Terms, for any failure or delay in performance when and to the extent such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, including without limitation: acts of God, flood, fire, earthquake, tornado, hurricane, or other severe weather events; governmental actions; war, invasion, or hostilities; terrorist threats or acts; riot or other civil unrest; national emergency; epidemic or pandemic; strikes or other labor disputes; telecommunications breakdown or power outage; or inability or delay in obtaining supplies or materials from third-party data providers.
We may update these Terms of Use from time to time by posting amended Terms on our website. Your continued use of the Services after changes constitutes acceptance of the new terms. We will update the "Last Updated" date when changes are made.
TornadoPath reserves the right, at any time, to modify, suspend, or discontinue, temporarily or permanently, the Services (or any part thereof) without notice to you. You agree that TornadoPath shall not be liable to you or to any third party for any unavailability, modification, suspension, or discontinuance of the Services.
We reserve the right in our sole discretion and at any time to terminate or suspend your access to the Services for any reason, including without limitation if you have failed to comply with these Terms. You agree that we are not liable to you or any third party for any termination or suspension of your access. Any suspension or termination shall not affect your obligations to us under these Terms. The provisions of these Terms which by their nature should survive termination shall survive, including but not limited to indemnities, disclaimers, limitations on liability, dispute resolution, and no class action provisions.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to conflict of law provisions. You agree that any dispute arising under these Terms or your use of the Services shall be resolved exclusively by state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.
If any term or provision of these Terms is found to be invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of these Terms or invalidate or render unenforceable such term or provision in any other jurisdiction. The remaining provisions shall continue in full force and effect.
