Agreement to Terms

By downloading, installing, or using Tornado Tracker by TornadoPath, a product of Ridge Labs LLC ("the App"), including without limitation the website at tornadopath.com, the iOS application, and any related services (collectively, the "Services"), you acknowledge that you have read and understood the terms and conditions of this Agreement and agree to be bound by all terms and conditions herein. If you do not agree to these terms, do not use the Services.

Description of Service

Tornado Tracker by TornadoPath provides tornado tracking, severe weather alerts, and notification services. The App displays weather data from the National Weather Service (NWS), Storm Prediction Center (SPC), and NOAA.

Pro Subscription Options

Tornado Path Pro is available with the following pricing:

1. Annual Subscription

• Price: $39.99 per year (equivalent to $3.33/month)
• Free Trial: 3-day free trial included for new subscribers
• Billing: After the 3-day free trial, you will be charged $39.99. Subscription automatically renews each year.
• Cancellation: Cancel anytime. If you cancel during the free trial, you will not be charged. If you cancel after being charged, access continues until end of billing period.

2. Lifetime Access

• Price: $149.99 (one-time purchase)
• Billing: Single payment, no recurring charges
• Access: Unlimited access to all Pro features forever

Free Trial & Auto-Renewal Terms

For the Annual subscription:

• New subscribers receive a 3-day free trial before being charged
• If you do not cancel before the free trial ends, your Apple ID account will be charged $39.99
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions by going to your App Store account settings after purchase
• Any unused portion of a free trial period will be forfeited if you purchase a different subscription

Prices are in USD and may vary in other countries. Prices are subject to change with notice.

Cancellation & Refunds

For Annual Subscriptions

• You may cancel your subscription at any time through your Apple ID settings
• If you cancel during the 3-day free trial, you will not be charged
• Cancellation takes effect at the end of the current billing period
• No partial refunds for unused time within a billing period
• Refund requests must be submitted to Apple directly

For Lifetime Purchases

• Lifetime access is a one-time, non-refundable purchase
• Refund requests must be submitted to Apple within their refund window
• Once purchased, access to Pro features is permanent

• Phone calls when tornado warnings are issued (breaks through Do Not Disturb)
• SMS text messages with warning details
• Email bulletins with full NWS statements
• Monitor up to 5 locations
• Alert up to 2 phone numbers
• Alerts delivered when NWS warnings are issued

Pro Map Layers

• HD Radar (MRMS high-resolution radar)
• Forecast Radar (predictive storm modeling)
• Echo Tops (storm height visualization)
• Storm Cells (TVS, mesocyclone, and hail detection)
• Satellite imagery (cloud formations)
• Precipitation overlay (rainfall details)

Electronic Communications

By subscribing to our alert services (phone calls, SMS text messages, or email alerts), you represent and warrant that you are the lawful owner or authorized user of the phone number(s) and email address(es) you provide. You consent to receiving automated phone calls and text messages as part of the alert services. If your contact information changes, you must update it promptly.

Standard call and message rates may apply from your mobile or wireless carrier. The frequency of alerts may vary depending on weather conditions and your alert settings. You may cancel alert services at any time through your dashboard or by contacting us.

Our use of the Services complies with applicable laws including the Telephone Consumer Protection Act (TCPA) and the CAN-SPAM Act.

Disclaimer of Warranties

Weather Data Accuracy

THE SERVICES DISPLAY WEATHER DATA FROM THIRD-PARTY SOURCES (NWS, SPC, NOAA, ECCC). WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR TIMELINESS OF THIS DATA. ANY SAFETY-RELATED INFORMATION PROVIDED THROUGH THE SERVICES IS NOT INTENDED TO BE A SUBSTITUTE FOR OFFICIAL GOVERNMENT EMERGENCY ALERTS OR PROFESSIONAL SAFETY ADVICE.

No Guarantee of Alert Delivery

WE CANNOT GUARANTEE THAT ALERTS WILL BE DELIVERED OR RECEIVED due to:

• Network connectivity issues
• Phone carrier limitations
• Device settings (Do Not Disturb, etc.)
• Third-party service outages (Twilio, email providers)
• System maintenance or technical issues
• Power outages or infrastructure failures
• Delays or errors in third-party data sources

Not a Replacement for Official Warnings

THE SERVICES ARE NOT A REPLACEMENT FOR OFFICIAL EMERGENCY ALERT SYSTEMS. Never disregard official safety guidance or delay seeking shelter because of information provided through our Services. Always:

• Monitor local news and weather stations
• Have a NOAA Weather Radio
• Follow official emergency management guidance
• Have multiple sources of weather information

Limitation of Liability

THE SERVICES, INCLUDING ALL CONTENT, SOFTWARE, FUNCTIONS, MATERIALS, AND INFORMATION MADE AVAILABLE THROUGH THE SERVICES, ARE PROVIDED "AS IS" AND "AS AVAILABLE." TORNADOPATH MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from your use of the Services
• We are not liable for any injury, death, or property damage resulting from severe weather events
• We are not responsible for missed alerts or delayed notifications
• We do not warrant that access to the Services will be uninterrupted or error-free
• Our total liability shall not exceed the amount you paid for the Services in the twelve (12) months immediately preceding the event giving rise to your claim
• Your sole remedy for dissatisfaction with the Services is to stop using the Services

User Responsibilities

You agree to:

• Provide accurate contact information for alerts
• Maintain your own emergency preparedness plans
• Not rely solely on this App for weather warnings
• Keep your device charged and connected during severe weather
• Verify alert settings are configured correctly

Prohibited Uses

You may not:

• Use the App for any unlawful purpose
• Attempt to reverse engineer or modify the App
• Resell or redistribute alerts or data from the App
• Use the App to harass or send unwanted communications
• Interfere with the App's operation or servers

Indemnification

You agree to defend, indemnify, and hold harmless TornadoPath, its affiliates, and their respective officers, directors, employees, and agents from and against all claims, losses, costs, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) any violation of these Terms by you; (c) any improper or unauthorized use of the Services by you; (d) any conduct, activity, or action which is unlawful or violates the rights of any individual or entity, engaged in or facilitated through the Services; or (e) your acts or omissions. You agree to cooperate fully with us in the defense of any such claim.

Intellectual Property

The Services, including their design, features, content, text, data, graphics, maps, and software (excluding third-party weather data), together with the selection and arrangement of such materials, are the property of TornadoPath and are protected by copyright, trademark, and other intellectual property laws. The removal of any trademark, copyright, or other rights notice is strictly prohibited. Except as expressly permitted herein, any use, reproduction, modification, distribution, or exploitation of the materials, in whole or in part, is strictly prohibited without the prior express written consent of TornadoPath.

Third-Party Content and Links

The Services may contain links to third-party websites or display content from third-party sources. We do not operate or control, and do not necessarily endorse, the content found on these third-party websites. You assume sole responsibility for your use of third-party links. We are not responsible for any content posted on third-party websites or liable to you for any loss or damage incurred as a result of your dealings with any third party or their website. In many instances, content will include data from third-party sources (NWS, ECCC, NOAA). We do not endorse, warrant, and are not responsible for the accuracy, completeness, or reliability of any third-party data.

Dispute Resolution and Arbitration

Each party agrees to first contact the other with any disputes and provide a written description of the problem, all relevant documents and information, and the proposed resolution. You agree to contact us at hello@tornadopath.com.

If after thirty (30) days the parties are unable to resolve any dispute, the dispute shall be submitted to binding arbitration. Each party agrees that any claim or dispute, including past, present, and future claims, shall be resolved by binding arbitration rather than in court. Either party may bring qualifying claims in small claims court. The arbitration shall be governed by the Federal Arbitration Act. Any award by the arbitrator may be entered as a judgment in any court having jurisdiction.

No Class Actions

TO THE EXTENT ALLOWED BY LAW, YOU AND TORNADOPATH EACH WAIVE ANY RIGHT TO PURSUE DISPUTES ON A CLASS-WIDE BASIS; THAT IS, TO EITHER JOIN A CLAIM WITH THE CLAIM OF ANY OTHER PERSON OR ENTITY, OR ASSERT A CLAIM IN A REPRESENTATIVE CAPACITY ON BEHALF OF ANYONE ELSE IN ANY LAWSUIT, ARBITRATION, OR OTHER PROCEEDING. If for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate does not apply and the class-wide dispute must be brought in court.

Force Majeure

TornadoPath will not be liable or responsible to you, nor be deemed to have defaulted or breached these Terms, for any failure or delay in performance when and to the extent such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, including without limitation: acts of God, flood, fire, earthquake, tornado, hurricane, or other severe weather events; governmental actions; war, invasion, or hostilities; terrorist threats or acts; riot or other civil unrest; national emergency; epidemic or pandemic; strikes or other labor disputes; telecommunications breakdown or power outage; or inability or delay in obtaining supplies or materials from third-party data providers.

Changes to Terms and Services

We may update these Terms of Use from time to time by posting amended Terms on our website. Your continued use of the Services after changes constitutes acceptance of the new terms. We will update the "Last Updated" date when changes are made.

TornadoPath reserves the right, at any time, to modify, suspend, or discontinue, temporarily or permanently, the Services (or any part thereof) without notice to you. You agree that TornadoPath shall not be liable to you or to any third party for any unavailability, modification, suspension, or discontinuance of the Services.

Termination

We reserve the right in our sole discretion and at any time to terminate or suspend your access to the Services for any reason, including without limitation if you have failed to comply with these Terms. You agree that we are not liable to you or any third party for any termination or suspension of your access. Any suspension or termination shall not affect your obligations to us under these Terms. The provisions of these Terms which by their nature should survive termination shall survive, including but not limited to indemnities, disclaimers, limitations on liability, dispute resolution, and no class action provisions.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to conflict of law provisions. You agree that any dispute arising under these Terms or your use of the Services shall be resolved exclusively by state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.

Severability

If any term or provision of these Terms is found to be invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of these Terms or invalidate or render unenforceable such term or provision in any other jurisdiction. The remaining provisions shall continue in full force and effect.

• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any claims related to the App
• Apple is a third-party beneficiary of these Terms

By using Tornado Tracker by TornadoPath, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use, the Privacy Policy, and any other agreements or policies referenced herein.
